1. SCOPE OF APPLICATION

The purpose of these general terms and conditions of use (the “GTCU”) is to define the conditions under which you can consult the Site. By browsing the Site, you acknowledge that you have read and accepted the GTCU.

SEALK may modify the GTCU at any time, in particular for commercial reasons, in order to adapt to the technological environment, or in order to comply with the regulations in force. You should therefore check the Site regularly to stay informed of any changes or updates to the GTCU.

2. INTELLECTUAL PROPERTY
The Site architecture, trademarks, domain names, databases, software, content and all other elements comprising the Site, without this list being exhaustive (hereinafter the “Protected Elements”), are the exclusive property of SEALK or the property of third parties who have granted a license thereto. The GTCU does not convey any intellectual property rights in the Site or the Protected Materials to you.
You shall refrain from any action that may infringe, directly or indirectly, on SEALK’s intellectual property rights, or, if applicable, on the property rights of third parties to the Protected Elements. Thus, the reproduction, representation, transmission, modification, marketing or creation of derivative works based on the Protected Elements without the prior written consent of SEALK are strictly prohibited and may be punished as infringement.

3. PROHIBITED BEHAVIORS
SEALK is an automated data processing system. Any fraudulent access or maintenance within the latter is prohibited and punishable by law. The same applies to any interference with or alteration of the operation of this system, or in the event of the introduction, deletion or modification of data contained therein. Thus, you undertake not to disrupt the proper functioning of this automated data processing system, and in particular not to introduce viruses, nor to damage, illegally access or modify the data stored on the Site.
You must not extract and/or reuse parts of the content of the Site without the prior written authorisation of SEALK. In particular, you may not use any robot data collector or similar data gathering tool to extract or reuse any substantial part, or any insubstantial part but in a systematic or repeated manner, of the elements contained on the Site.
You agree not to access or attempt to access the Site by any means other than through the Site interface provided by SEALK, and not to engage in any activity that would interfere with or disrupt the operation of the Site.

4. OPERATION AND AVAILABILITY OF THE SITE
SEALK will make every effort to keep the Site available 24 hours a day, 7 days a week. Nevertheless, access to the Site may be temporarily suspended due to technical maintenance operations, migrations or updates, or constraints related to the functioning of the Internet.
It is reminded that the transmission of data on the Internet is only relatively reliable. The networks on which the data circulate have different characteristics and capacities and are likely to be saturated at certain times of the day, which may affect their download times and accessibility.

5. RESPONSIBILITY
The Site is reserved for the private use of each user.
SEALK cannot be held liable to you for any indirect damage resulting from your use of the Site (including but not limited to any loss of data, loss of customers or business, loss of chance or opportunity, damage to reputation) or from your inability to access it, from your use of the elements contained on the Site, from any failure, error or interruption of the Site.
SEALK will use its best efforts to secure your access to the Site, but cannot guarantee its absolute security. The Company shall not be held responsible for any malfunction or damage inherent to the use of the Internet, such as service interruption, external intrusion or presence of computer viruses, or for computer security breaches that may cause damage to your computer equipment and data.
Furthermore, SEALK cannot be held responsible for the consequences resulting from your violation of the GTCU. Thus, you agree to indemnify SEALK in the event of action by third parties, or condemnation of the latter resulting from your act.

6. HYPERTEXT LINKS
The Site may contain hypertext links to third party sites. Insofar as SEALK does not have control over these sites, it can in no way guarantee or be responsible for the availability of these sites, the content or other elements found on these sites or the transactions that you may carry out on these third-party sites.

7. PROTECTION OF PERSONAL DATA
When you visit the Site, and in order to provide you with the services offered on the Site, SEALK may process personal data about you.
